Group sues cosmetic companies for falsely labeling products organic

(NaturalNews) Kiss My Face, Hain-Celestial, and 24 other consumer and cosmetic product companies are the subject of a new lawsuit filed by the Center for Environmental Health (CEH), a California-based group that works to protect the public from toxic chemicals, and promote products and practices that improve public health and the environment. The companies are all accused of improperly labeling various products as “organic” that do not contain at least 70 percent organic ingredients, as is required by California law. The California Organic Products Act of 2003 requires that any product labeled “organic” contain at least 70 percent organic ingredients. But Michael Green, Executive Director of CEH, says that after purchasing a variety of products made by the companies in question, his group determined that many of them were in clear violation of the law. “For years, organic advocates have called on personal care companies to fix their improper ‘organic’ labels, but our recent purchasing shows the industry is still rife with unsubstantiated organic claims,” said Green. “We want to encourage companies to use organic ingredients, and insure that consumers can trust organic labels to be meaningful and consistent.” Currently, there are no federal laws or established standards governing how organic personal care and cosmetic products are to be labeled. So many manufacturers blatantly market and sell products as “organic” that are loaded with petrochemicals and other harmful toxins. Armed agents invade Maxam Nutraceutics and steal natural health products in shocking FDA raid

(NaturalNews) Amidst all the destructive activities taking place in our world today that deserve attention, the US Food and Drug Administration (FDA) has decided instead to make it a personal mission to destroy the businesses and livelihoods of those trying to help people through natural medicine. On Thursday, April 14, 2011, dozens of agents from the FDA, the Internal Revenue Service (IRS), and the US Federal Bureau of Investigation (FBI) conducted an unprovoked, full-scale raid on Hood River, Ore.-based Maxam Nutraceutics, a company that produces and sells nutritional supplements primarily for autism spectrum disorders (ASD) and Alzheimer’s disease. Back in October 12, 2010, the FDA sent a warning letter to Jim Cole, Founder and CEO of Maxam, notifying him that several of his company’s products were not labeled in accordance with the US Food, Drug and Cosmetic Act. The letter also stated that Maxam had fifteen days from the receipt of the letter to notify the FDA compliance officer of the specific steps it planned to take in order to correct the violations. They were merely customer testimonials about the products that had been accumulated over the years from satisfied customers, and posted online alongside product descriptions on Maxam’s website. Nevertheless, the FDA considered the testimonials to be marketing violations that automatically rendered the products as drugs. According to Jim, his company immediately responded to the FDA letter by calling the compliance officer and telling her “it was [the company's] intention to come into full compliance as quickly as possible.” This included removing all the offending testimonials from the company website after being told by the FDA compliance officer that they were not permitted. “I contacted a patent and copyright attorney, and he had written [the compliance officer] a letter that it was our intention to come into full compliance,” said Jim, noting that his company responded within two days of receiving the FDA warning letter, long before the 15-day deadline period. “So we took down the testimonials, and we thought that was good. And I hired an FDA copyright person [who] went over all the offending verbiage through the website.” Jim cooperated with every demand that the FDA made of him, and was convinced that all was well. But apparently the FDA had different ideas when out of nowhere, the agency, along with the IRS and the FBI, sent as many as 80 armed, SWAT-style agents to both Maxam headquarters, the company’s “Big Gym” training center, and even Jim’s daughter’s house, to confiscate all the products, company documents, and even personal files and computers. “They took all our products, all our paperwork, all our files — we’ve been doing this since 1992 and they pulled everything,” said Jim. “They brought in three big moving vans, they had their guns on, their bullet-proof vests — they came prepared for war.” The armed agents also stole 27 TurboSonic machines, which is a sound-actuated vibration plate device that Jim invented to stimulate growth plates in the body, improve circulation, energize the lymphatic system, and improve muscle strength. The TurboSonic machines were not even mentioned in the FDA warning letter. “We also have a big Olympic training center up here called the ‘Big Gym’ — they went into the gym, they took all the paperwork, all the computer, hard drives, downloaded all of our servers, and trashed a couple of our servers going out,” added Jim. “They took products that were not on the list. I had an old bodybuilding line that went back to 1992, they took all of that. They pretty much just had a free-for-all.” According to Jim, the agents stole “hundreds of thousands of dollars in products” as part of the raid, as well as personal files, insurance policies, non-printed checks, and even unopened packages of manila filing folders from an office supply store. Clearly, the FDA’s intent was to terrorize and intimidate this small company that, from all available accounts, did absolutely nothing wrong. Maxam is currently “waiting for the dust to settle” as it pursues legal action against the offending agencies. Until then, the world must know about this terrible injustice and crime against humanity. The FDA has clearly shown itself to be a terrorist organization that has no respect for the rule of law, or for common decency. To perform a SWAT-style raid against a company that was doing everything it could to follow the law and conduct business honestly and legally is a travesty in this supposed “land of the free.”

Tell Congress to support the Free Speech about Science Act of 2011

This year, Reps. Jason Chaffetz (R-Utah) and Jared Polis (D-Colo.) have introduced the bill, also known as HR 1364, before the 112th Congress, and they need your help to get it passed. As many NaturalNews readers probably already know, the US Food and Drug Administration (FDA) has severely limited the free speech of practically everyone besides drug companies. Supplement manufacturers, natural food companies, and even produce growers are prohibited from making honest, scientifically-proven health claims about their products , even when such claims are supported by peer-reviewed studies. As a result, millions of Americans are left in the dark about how natural foods, herbs, and supplements can help them prevent and cure disease. This is where FSAS comes in. If passed, the bill will amend current law to allow growers and manufacturers to freely share honest information about food and supplements with their customers . While the bill will still allow the FDA and the US Federal Trade Commission (FTC) to go after companies that are truly making false claims, the agencies will no longer be able to tyrannize those companies that simply share the truth with the public . On numerous occasions, the FDA has aggressively pursued companies for making legitimate health claims. In 2010, for example, the FDA went after Diamond Nuts for making honest health claims about its walnuts. The agency claimed that because Diamond was making health claims about walnuts, those walnuts automatically became “unapproved drugs” — even though such claims were based entirely on results from legitimate scientific studies (http://www.fda.gov/ICECI/EnforcementActions/WarningLetters/ucm202825.htm). The FDA did the same thing to cherry growers in 2005 when it sent cease and desist letters to 29 cherry growers that were including scientific studies about the health benefits of cherries on their product packaging. These examples and more clearly illustrate the need to pass FSAS as soon as possible in order to help restore freedom of health speech. Tests reveal that some ‘green’ products still contain petrochemicals

(NaturalNews) The burgeoning natural and organic household product sectors are solid evidence that the public is becoming increasingly conscious of the importance of avoiding synthetic chemicals. But a new study presented at the 241st National Meeting and Exposition of the American Chemical Society (ACS) has revealed that some “green” cleaning products still contain ingredients derived from petroleum. In an analysis of more than a dozen different commercial liquid laundry detergents, dishwashing liquids, and hand cleansers, researchers found that some of them contained as much as 57 percent carbons derived from petrochemicals. And some of these even bore labels saying “petrochemical free,” which indicates some major discrepancies within the industry. “The plant-derived carbon content of the product samples tested was largely inconsistent with some of the content claims made on packaging,” said chemist Cara A.M. Bondi who worked on the project. “For example, a liquid laundry detergent that makes the claim ‘petrochemical free’ contained only 69 percent plant-based carbon, meaning that 31 percent of the carbon in this sample is, in fact, petroleum-derived.” In hand cleansers, plant-based carbons represented anywhere from 28 to 97 percent of overall carbons, depending on the brand. Liquid laundry detergents ranged from 28 to 94 percent, and dishwashing liquids from 43 to 95 percent. Even so, all products marketed or labeled as green contained 50 percent or more plant-based carbon than non-green alternatives. Seventh Generation (SG), a highly reputable name in the green products industry, says that because there is no official standard for regulating claims made by companies marketing their products as “green,” “sustainable,” or “eco-friendly,” there is no verifiable way to determine whether or not their claims are accurate. So SG has proposed making carbon-14 dating, a technique that identifies whether or not carbon molecules are of a natural and renewable origin, the modus operandi for testing green products. The company effectively used carbon dating in its tests to determine the presence of petroleum-based carbon. SG did not reveal the names of the companies or products that contained petrochemicals, and instead chose to promote the carbon dating testing method as a way for companies to help improve their products. Cornucopia Institute pushes USDA to crack down on organic labeling confusion

(NaturalNews) When Dean Foods, owner of the Silk soy milk brand, quietly changed its core product line from organic to conventional in 2009, it did so without also changing its UPC or product labeling, which confused customers and retailers, some for many months. This and several other cases of organic confusion have spurred the Cornucopia Institute (CI), a Wisconsin-based food and farm policy group, to petition the U.S. Department of Agriculture’s (USDA) National Organic Standards Board (NOSB) to update its organic requirements in order to preserve the integrity of the organic name. Readers may also be familiar with Peace Cereal, a granola and cereal brand that three years ago also quietly dropped its organic status. Just like Dean Foods, Peace did not notify its retailers or customers about the change, and kept the same UPCs for its products. So for months, and even years, some retailers continued to mistakenly label and sell the products as organic because they failed to observe the change as the products basically appeared the same. Such confusion, if left unchecked, is likely to hurt the reputation of the entire organic industry as consumers may begin to question the legitimacy of organic labeling. So CI has filed a formal request asking the Secretary of Agriculture to require that both UPCs and product labeling be changed when a product is downgraded from organic to conventional, and also that formal notifications be sent to distributors, retailers, and customers to make them aware of the change. “Any change in organic status requires new labels and packaging, since the USDA strictly regulates the use of the term ‘organic’ on food packages,” stated Charlotte Vallaeys, a Farm and Food Policy Analyst with CI. “We believe that a change in the barcode is a simple step that every manufacturer should be obligated to take to ensure that all distributors and retailers are aware that the product has changed.” Customers are also urged to carefully inspect all products labeled organic on store shelves to ensure that they bear an official seal of organic certification on their packaging. Organic giants Whole Foods, Organic Valley, and Stonyfield accused of compromising on GMOs

(NaturalNews) Some of the nation’s largest and most widely known producers and retailers of natural and organic products have decided to push for a compromise with the Monsanto-influenced U.S. Department of Agriculture (USDA) on the issue of genetically-modified organisms (GMO). In the wake of the recent decision by the Obama administration to carelessly deregulate genetically-modified (GM) alfalfa, Whole Foods Market and several other companies, including Organic Valley and Stonyfield, have expressed support for what they call “coexistence” between organics and GMOs. On January 20, 2011, Whole Foods issued a public letter on its blog expressing opposition to the deregulation of GM alfalfa over contamination and safety issued that remain unaddressed. But because the USDA refused to properly evaluate the evidence against GM alfalfa and rightfully ban the crop, Whole Foods took what it saw as the next best option and came out in support of a “coexistence” plan involving partial deregulation. The company argues that partial deregulation will at least place some restrictions on the cultivation and use of GM alfalfa. But will coexistence offer a viable option for preserving the integrity of organic and conventional non-GMO crops and livestock? All available evidence points to a solid NO. Alfalfa, which is a primary food source for dairy cows and beef cattle, is a highly-volatile perennial plant. Unlike other GM crops currently being cultivated, alfalfa is an open-pollinated crop, which means birds, bees, and other insects freely pollinate it in an uncontrolled way. Its seeds and pollen can be spread far and wide all year long, which cause every future generation of alfalfa to have differing genetic traits. So once an alfalfa plant is cultivated, whether natural or GM, there really is no stopping either its proliferation or its mutating effect on both nearby plants and future plantings of new alfalfa. The long-term result of GM alfalfa cultivation is eventually the contamination of all non-GM and organic varieties of practically any and all crop varieties with which it comes into contact. And as these other crops become contaminated, the entire human and animal food supply will eventually become tainted with GM materials, including organic and non-GM crops and animals. In other words, there is no such thing as a coexistence plan because everything will eventually end up becoming contaminated with GM traits. GM alfalfa is useless and will only cause more problems for agriculture As mentioned in a previous NaturalNews article on the issue, GM alfalfa is completely unnecessary in the first place. More than 90 percent of the conventional varieties currently grown in the U.S. require absolutely no pesticides or herbicides, according to . But in the interests of expanding its control over the food supply as well as its profit margins, Monsanto has pushed, and now succeeded, in getting GM alfalfa approved. And it seems to have hoodwinked a few large organic giants to play the negotiation game rather than pursue legal action against the approval. Whole Foods has repeatedly stated that it continues to support truth-in-labeling efforts that encourage transparency with GMOs, and it has also routinely taken a stance against GMOs in general. And these efforts are commendable. But the retailer still continues to sell many “natural” product brands that contain GMO ingredients. And while its store-brand line of “365 Everyday Value Products” is part of the Non-GMO Project, a noteworthy effort at sourcing clean, GMO-free food, the retailer does not require other products in its stores that contain GMO ingredients to be labeled. Whole Foods is now urging its patrons to call Congress, the USDA, and the White House, to demand support for a coexistence plan. Though better than nothing, this plan of action, as previously mentioned, will do nothing to prevent the widespread contamination of non-GM and organic crops. If GM alfalfa is allowed to “coexist” with other crops, there will eventually be no distinction between organic, non-GM, and GM crops, because every crop will become contaminated with GMOs. This is why citizens must continue to fight GM alfalfa period. The Organic Consumer Association (OCA) is calling on the public to pressure not only Whole Foods, but also other retailers like Trader Joe’s, and even conventional grocers like Wal-Mart and Safeway, to implement voluntary “truth-in-labeling” practices that require any products sold in their stores that contain GMOs to be labeled. If Whole Foods really wants to show its opposition to GMOs, it will either require GMO labeling, or it will outlaw every products from its store that contains them. Fox News contacted Kellogg’s about the matter, and they said — get this — that “The term ‘Blueberry Muffin’ is used to describe the flavor of some products. All our products are labeled in compliance with applicable laws and regulations.” In other words, as long as there isn’t a law against misleading consumers about the fake ingredients in their products, they’re going to keep doing it, it seems. NaturalNews encourages consumers to continue boycotting General Mills over their deceptively labeled cereals and fake blueberry ingredients. When I write stories here on NaturalNews that expose the truths behind the dishonest corporations that rule our world, I never expect these stories to get mentioned in the mainstream media. That’s because most of our stories go after the very same corrupt, dishonest corporations that fund most media — pharmaceutical companies, for example, or processed food manufacturers. Most media outlets simply refuse to publish stories that offend their advertisers. So these stories are usually circulated exclusively through the “alternative press” circles, which include blogs, Facebook pages, tweets, and alternative news sites like Infowars.com or Rense.com. The mainstream media, for the most part, simply tries to ignore NaturalNews, not realizing that we are slowly taking all their readers! As newspaper circulation drops by the day, NaturalNews readership keeps rising. When we called out the LA Times for writing an article that literally recommended “preventive chemotherapy” for women who have no breast cancer (but who are afraid they might get it one day), the LA Times never even responded. They simply try to pretend that the alternative press doesn’t exist, even while their own readership is slowly slipping away. People prefer to read the truth about matters, not just some corporate spin B.S. that you normally get in popular newspapers. NaturalNews is journalism 2.0 , and we do investigations (yes, investigations!) about topics that matter to real people. And we speak directly to our audience. I write in the first person. Why? Because I don’t try to pretend that this is all being said by some unnamed authoritative voice that has no opinions or passions. In journalism school, they tell you to basically “write like a robot” and leave your own experience and passions out of it. I think that’s nonsense. People want to hear from real people. Readers want to know not only what you found out, but what you feel and believe, too . Readers want to know the people behind the news: Who’s writing that news? What do they really believe? What do they feel passionate about? That’s why here at NaturalNews, I write from the heart, and I share my passions, experience, hopes and concerns with readers every single day. We certainly welcome mainstream coverage of our stories, but we never expect it. And frankly, we don’t need it. Independent news organizations like NaturalNews are gaining all the readers that the mainstream print news juggernauts are losing. There’s a reason for that. And I think that reason is pretty simple: People are tired of corporate press releases being repackaged as “news.” They’re tired of being spoon fed a pack of lies each day. They want to know what’s really going on in the world, with GMOs, vaccines, health freedom, nutritional science, natural cures and much more. And about the Google ads on our articles, we keeping banning every drug ad that shows up there, but the drug companies keep coming up with new URLs to use. So we’re doing the best we can to ban those ads as quickly as possible. In the long run, we may need to find a better solution or work with Google to find some way to disallow all pharma ads entirely. I hate it when I open an article on NaturalNews and I see some pharma ad there because Google’s ad algorithm selected it. Believe me, we are constantly trying to BAN all those ads! (And we’re pretty effective most of the time.)
